These Terms of Use govern your use of Open Pool, provided by Quan Dang. By downloading or using the app, you agree to these terms.
Open Pool is licensed to you, not sold, under Apple's Licensed Application End User License Agreement (the Standard EULA). These terms add to the Standard EULA; where they conflict, the Standard EULA applies to the app license.
Open Pool is a free download, and the Technician pool is free. If you buy the unlock for the General and Extra pools and their practice exams, it is a single one-time payment, not a subscription, and nothing renews. The price is shown in the app before you buy and may vary by country. Payment is charged to your Apple ID account and handled by Apple. Refunds are handled by Apple; the developer cannot issue them directly. You can restore a purchase on another device signed in with the same Apple ID using Restore Purchases in the app, and the unlock can be shared through Family Sharing.
Open Pool is a study aid for exam preparation. It does not guarantee that you will pass any amateur radio license exam. Exams are administered by Volunteer Examiners, and the question pools change on their published schedule; check that you are studying the pool in effect on your exam date.
Open Pool is not affiliated with, endorsed by, or sponsored by the FCC, NCVEC, ARRL, or any VEC.
The exam questions and figures come from the question pools published by the NCVEC Question Pool Committee, which are in the public domain. The app's software, design, and original text are owned by Quan Dang.
You agree to use Open Pool only for lawful purposes and in compliance with these terms and the Standard EULA. You agree not to interfere with the app's operation or reverse engineer it except as permitted by applicable law.
The app is provided on an “as is” and “as available” basis. We may modify, update, or discontinue features of the app at any time.
To the maximum extent permitted by applicable law, Quan Dang provides Open Pool without warranties of any kind, whether express or implied. In no event shall Quan Dang be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of data, arising out of or related to your use of or inability to use the app.
We may update these terms from time to time. Any changes will be posted on this page with an updated date. Your continued use of Open Pool after changes are posted constitutes your acceptance of the updated terms.
